Terms of Service

Last updated October 21, 2026

These Terms of Service (“Terms”) are an agreement between you and EZ Game Host, LLC (“we”, “us”), which operates StackShip, including the website, dashboard, API, MCP server, and documentation (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service for an organization, you agree on its behalf and confirm you have authority to do so.

1. Accounts

You must be at least 16 years old and able to form a binding contract. Give accurate account information and keep your password and tokens secure. You are responsible for activity under your account and your organization’s accounts, tokens, and connected tools, including AI agents you authorize.

Tell us right away at compliance@ezgamehost.com if you suspect unauthorized access.

2. Your infrastructure

StackShip runs OpenTofu plans and applies against cloud accounts you connect. You decide what runs and who approves it. You are solely responsible for your infrastructure code, the changes you approve, the cloud resources they create, change, or destroy, and any resulting costs from your cloud providers.

Review every plan before you approve it. We are not responsible for changes made by an approved run.

3. Acceptable use

You agree not to:

  • Break the law or infringe anyone’s rights.
  • Mine cryptocurrency, send spam, or run workloads unrelated to managing infrastructure.
  • Attack, probe, or overload the Service or other users, or bypass its limits or security controls.
  • Upload malware or content you have no right to use.
  • Resell the Service or access it to build a competing product.

We may suspend access that violates these rules or puts the Service or other customers at risk.

4. Your content

You keep all rights to the content you put in the Service, including configuration, plans, state, logs, variables, and policies (“Customer Content”). You grant us a limited license to host, process, and transmit Customer Content only to provide and secure the Service.

We handle personal data as described in the Privacy Policy, using the subprocessors listed on our site.

5. Our service

The Service, including its software, design, and documentation, belongs to us and our licensors. OpenTofu and other open source components remain under their own licenses. If you send us feedback, we may use it without obligation to you.

6. Fees

StackShip is currently free. If we introduce paid plans, we will announce the prices in advance, and nothing will be charged without your agreement. We may set reasonable usage limits.

7. Third-party services

The Service connects to third-party services such as GitHub, Google, identity providers, and cloud providers. Your use of them is governed by their own terms, and we are not responsible for them.

8. Termination

You may stop using the Service and delete your organization at any time. We may suspend or end your access if you breach these Terms, if required by law, or if we discontinue the Service. We will give reasonable notice when we can, and a chance to export your state and other Customer Content, unless that would be unlawful or create a security risk.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limits of liability, and indemnity.

9. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that runs will produce any particular result.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or cloud costs, even if advised of their possibility. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or one hundred U.S. dollars (US$100).

11. Indemnity

You will defend and indemnify EZ Game Host, LLC against third-party claims arising from your Customer Content, your infrastructure changes, or your breach of these Terms.

12. Changes to these terms

We may update these Terms. We will change the date at the top and, for material changes, notify account owners by email or in the Service at least 30 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.

13. General

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-laws rules. The state and federal courts located in California have exclusive jurisdiction, and you and we consent to their personal jurisdiction. If any part of these Terms is unenforceable, the rest remains in effect. These Terms, together with the policies they reference, are the entire agreement between you and us about the Service. You may not assign them without our consent.
